Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://argyllweddingphotography.co.uk website (the “Service”) operated by Argyll Wedding Photography (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Argyll Wedding Photography and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Argyll Wedding Photography.

Argyll Wedding Photography has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Argyll Wedding Photography shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Wedding Photography Terms and Conditions

 

In the following terms & conditions “the photographer” shall mean James Collett trading as Argyll Wedding Photography. “The client(s)” shall be those persons defined as bride and groom, groom and groom or bride and bride on the booking form/email. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed to by the photographer in writing.

 

1.            Copyright

  • Any images or copies of images whether stored digitally or otherwise including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer(s) in writing.

 

2.            Display

  • The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums, social media, competitions etc.

 

3.            License, Coverage and Reproduction

  • Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the client’s requirements.
  • The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct. During the initial consultation emails / meeting it will be discussed and agreed upon on a location for the private shoot if this is part of the client(s) package.
  • The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.
  • For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
  • Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

  • Some venues require financial payment for the use of lighting equipment, this will be established by either The Clients or Argyll Wedding Photography and will be added to the price of the chosen wedding package.

2.            Prices

  • All wedding packages and additional goods requested at the time of booking are supplied at the prices ruling on the date of booking as per Argyll Wedding Photography website https://argyllweddingphotography.co.uk/wedding-photography-packages/ or unless via an accepted discounted price by both parties usually agreed on via email or messaging app.

3.            Payments

  • A booking fee of £100.00 or £50.00 will confirm your booking, this may be cancelled within the first month of the confirmation date, thereafter the full deposit is non-refundable, as well as full acceptance of the terms and conditions as published on the photographer’s website or sent to The Clients via email, those sent via email will supersede the t&c’s on the website. The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due.
  • Payment in full of the remaining balance will be due one calendar month before the wedding day at the latest.
  • Additional goods ordered must be paid for in full at the time of full payment.
  • Titles to all goods remain with the photographer until paid for in full by the client(s).

 

4.            Force Majeure

  • The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding, landside, act of god etc.
  • In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

 

5.            Ownership

  • All digital negatives (computer files) remain the property of the photographer. On occasion, the photographer may supply a copy of the edited digital negatives to the client(s) for their own non-commercial use depending on the package chosen.

 

6.            Cancellation Fees

  • If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
  • Cancellation by the clients, the booking fee of £100.00 or £50.00 will be non-refundable after the first month of the confirmation date.
  • In the event of cancellation by the photographer, liability shall be limited to a full refund of any fees paid.

 

7.            Product Availability

  • In the event of a product being no longer available, such as an album, a suitable alternative of similar quality will be offered. The photographer’s choice of an alternative will be deemed as correct and acceptable.
  • Wedding Packages may be modified to suit The Clients needs and will be agreed upon.

 

8. Acceptance of Terms and Conditions

  Unless by written notification it is assumed that the client and Argyll Wedding Photography both agree to these terms and conditions.
